1. INVOICE:
The BUYER agrees to pay the total purchase price as specified on
your shopping cart order, in addition, the BUYER agrees to pay any
sales, freight charges or other taxes levied on or measured by such
purchase price, or arising from the use of the product(s) and any
parts or maintenance supplied, including without any limitation, any
additional sales, use gross receipts, privilege, excise, and
personal property taxes unless specified in writing on this
document.
2. LIMITED WARRANTY:
Bidders Bay provides a one-year limited warranty for the quality of
most its products in material and workmanship. OEM CPUs and Memory
have a 30 day limited warranty. All warranties are subject to the
terms and conditions of their respective manufacturers. During this
period, Bidders Bay will repair or replace all merchandise, which
proves to be defective. However, Bidders Bay will not warranty any
product, which have been subjected to improper freight
handling/shipping, physical damage, neglect, or unauthorized repair
or installation. Some products have longer warranties directly from
the individual manufacturer. All warranty will be voided if any
Warranty Sticker or Seal is broken off on the purchased products.
Any tempering of the warranty condition of any purchased products
voids the warranty of such products.
3. SPECIAL ORDER:
Bidders Bay will assist you in special order items. The following
rules apply:
Buyer must prepay for the special order product, shipping, and other
cost associated with the product
NO returns, exchanges, or refunds under any circumstance
Technical Support provided by manufacturer of product, not by
Bidders Bay
4. CHANGES AND CANCELLATION:
The following rules apply to changing or canceling orders:
a) Non-completed orders* (i.e. orders that have not been shipped)
can be changed or cancelled with no penalty
b) Completed orders* (i.e. packages that have already been shipped)
are subject to a 15% restocking fee and all freight/shipping charges
c) Freight charge is NOT refundable and or available for credit.
*Special rules apply to systems
5. SYSTEMS
The following rules apply to system orders:
In order to get system orders built and shipped as quickly as
possible, orders can only be changed or cancelled during the same
day that it was placed.
Systems are subject to a 20% restocking fee and the FULL cost of any
software
Bidders Bay will only warranty or repair the items that were bought
as part of the system. Additional peripherals, software, or hardware
will not be warranted, nor will any problem directly or indirectly
caused by those products (i.e. incompatibility issues, driver
issues, etc).
Bidders Bay will not repair damage caused by viruses, Trojan horses,
or other malicious programs
Bidders Bay is not responsible for data loss - please backup your
system regularly
6. DELIVERY:
Bidders Bay will make every reasonable effort to effect shipment on
or before the estimated delivery date set forth on the Bidders Bay
quotation and confirmed in Bidders Bay Computer's acknowledgement to
Purchaser’s order. Bidders Bay is not liable for delays caused by
Govt. orders, strikes, lockouts, floods, fires, explosions,
earthquakes, and other causes beyond Bidders Bay reasonable control.
Bidders Bay uses USPS & UPS for shipments and is subject to USPS &
UPS’s schedules.
7. RISK OF LOSS:
Shipment of all products shall be F.O.B. (free on board) Bidders Bay
facility. Title to and risk of loss or damage to product shall pass
to purchaser upon delivery to carrier at the F.O.B. point. Purchaser
shall be responsible for dealing with the carrier in the event of
carrier’s mis-delivery, loss or damage to product.
· LIMITATION: Bidders Bay shall not be liable for damage or penalty
as result of late or lost shipments, even if the purchaser has been
notified that such damages or penalties may apply.
8. RETURNS:
All returns must show on the outside shipping box a valid RMA
(Return Merchandise Authorization) number and include a copy of the
invoice showing serial numbers as labeled on the part/product. All
shipments received that do not clearly show an RMA number will be
automatically refused.
· To obtain an RMA number, email our RMA Department at
sales@mybiddersbay.com to request an RMA request form and fax back
with all the information requested on the form to get an RMA number.
RMA’s are handled Mon-Fri 9am-5pm
NO RETURNS OR REFUNDS FOR ANY SOFTWARE - NO EXCEPTIONS
A) Returning for Credit: Upon approval all new/used products with no
physical damage and accompanied by all the original accessories and
packaging will be accepted within 30 days from invoice date. No
credit is issued for any product after 30 days. No credit on CPUs,
memory, or hard drives after 7 days of purchase. Freight charge is
not refundable.
B) Returning for Repair/Replacement: the purchaser must prepay All
RMA shipments. A C.O.D. shipment will be refused. Bidders Bay will
not cross-ship products NO EXCEPTIONS. If individual components are
invoiced, only individual components can be returned. Please note
that the service or credit may be delayed or otherwise affected if
the above procedures are not followed. Bidders Bay will not be
responsible for any consequences due to such non-compliance.
Bidders Bay will NOT be responsible for any cost incurred due the
returning of any warranty products from the purchaser during the
warranty period. Bidders Bay will NOT be responsible for any cost or
loss incurred due any defective purchased products. Bidders Bay will
NOT be responsible for any cost or loss incurred during the
inoperative period of any defective purchased products. Bidders Bay
will NOT be responsible for any loss of Data and Contents on any
storage media devices. It is the Purchaser's responsibility to
backup all data and content on any media storage devices before
returning any warranty products.
All defective claims will be verified according to the reported
problem. No replacements will be made for non-defective items.
Bidders Bay Tech’s test all products for RMA and their word is
final. If their findings determine that the warranty has been voided
by misuse, physical damage, natural events/disasters (i.e. lightning
strikes, floods, fire, etc) or that the warranty has expired, the
product will be returned to you stating the reasons it is not being
replaced. Any attempts to dispute any charges due to a voided
warranty will result in the immediate closing of your account and
all documentation supporting Bidders Bay Computer's decision
including, but not limited to, this document and all testing
documents will be forwarded to your credit card company. RMA turn
around is based on product availability and also on Bidders Bay
Computer's vendors turn around, but Bidders Bay will do everything
possible to make the process quick and smooth.
9. TECHNICAL SUPPORT:
For better service to our valuable customers, our Tech Support
department is open Mon-Fri from 9:00 A.M. - 5:00 P.M. and can be
reached by emailing sales@mybiddersbay.com Please note your invoice
number, the problem and a number to reach you so that our Tech’s can
call if they have further questions.
Tech Support is only available for products bought from Bidders Bay.
10. ENTIRE AGREEMENT
This document constitutes the entire agreement between the BUYER and
Bidders Bay. It is intended as a complete and exclusive statement of
the terms used in this agreement and no course of prior dealings
between the parties and no usage of the trade shall be relevant to
supplement or explain any term used in this agreement. No agent,
employee, or representative of Bidders Bay has any authority to bind
Bidders Bay to any affirmation, representation, or warranty
concerning the product(s) sold under this agreement, unless the same
is included within this written agreement.
